Tourist rights: Tourist settlement

Any controversy linked to tourism issues may be handled and positively resolved through a settlement procedure.

The conciliation service is completely cost-free not only to those tourism businesses which adhere to the Professional Association of their province through the conciliation Office, but also to their customers and their vendors.

To facilitate the tourist participation, the Chamber of Commerce offers the possibility to carry out the conciliation through an audio and video on line connection. If it is necessary, it also provides to both the parties, still cost-free, an interpreter service.

How it works

The party who intends to activate the procedure needs to fill-out an activation form supplied by the conciliation office, in which all the information needed to identify the reasons for the controversy are specified.

The counter-party who intends to abide by this procedure, must fill-out an acceptance form and send it to the conciliation Office within fifteen (15) days after receiving the communication..
Once the procedure is accepted, the Administrative office proceeds to the nomination of a conciliator from the appropriate list kept by the Chamber of Commerce.
The list includes different professional figures, competent in specific sectors, experts in mediation and communication techniques. The choice will be made according to the type of controversy.
There will be one or more meetings between the parties and the conciliator. The goal of the latter isn't to determine the truthfulness of the facts on the basis of written or oral evidence, as it occurs in a court of law or arbitration trials, but to define what are the interests of both the parties and to find a common point of agreement. The search for a solution that is satisfactory to both parties occurs in an informal atmosphere without the need for their respective lawyers to be present.

In the case where a deal is reached, the procedure will be concluded with the signing of an agreement between the parties possessing the same value as a contract ( this means that it is binding for the parties).
In those cases where an agreement cannot be reached, there will be documentation of a failed conciliation attempt , and this can be shown as evidence in a court of law that the party was willing to come to an agreement.

Where it takes place

The meetings are held at the main office of the Chamber of Commerce of Lucca, or, on request by the parties, at the one in Viareggio. In the case that the parties and the conciliator are geographically distant then it is possible to perform the conciliation on-line or by phone.

Times and Costs

Times
A conciliation procedure is usually concluded in 30 days.

Costs
Up to 12/31/2008 or, however, until the funds made available by the 3/2/06 Decree by the Ministry have been used, the Chamber of Commerce of Lucca will provide its conciliation service to the consumers free of charge.
There is no need to post a duty stamp on either the conciliation request or acceptation forms.
